A TPD compliant vape is one that meets the UK's legal limits on tank size, bottle size and nicotine strength, carries the right packaging and warnings, and has been notified to the MHRA before sale. From October 2026, vaping liquid also needs a duty stamp. If a product misses any of these, it is the shop selling it that faces Trading Standards action. Here is what to check before stock goes on your shelves, whether you are buying vape kits, prefilled pods or e-liquids.
Table of Contents
The rules come from the Tobacco Products Directive, which the UK kept after Brexit as the Tobacco and Related Products Regulations 2016 (TRPR). The trade still calls them TPD. The core limits are:
| Rule | Limit |
|---|---|
| Tank or pod capacity | Maximum 2ml per tank |
| Nicotine e-liquid bottle size | Maximum 10ml |
| Nicotine strength | Maximum 20mg/ml |
| Shortfills (0mg) | No bottle-size limit |
| Packaging | Child-resistant, tamper-evident, with health warning and ingredients list |
| Registration | Notified to the MHRA before it can be sold |
| Duty stamp (from 1 Oct 2026) | Required on vaping liquid; selling unstamped stock is an offence from 1 April 2027 |
| Age restriction | 18+ only |
Every nicotine-containing vape and e-liquid sold in the UK must appear on the MHRA's published list of notified products. If you cannot find a product there, or the supplier cannot show you its notification, do not stock it.
Look for the nicotine health warning, a full ingredients list, the nicotine strength, child-resistant packaging and a leaflet. Products imported for other markets often fail here: the device may be identical, but the box is not UK-compliant.
From 1 October 2026, vaping liquid entering the UK market must carry a duty stamp. Older stock made before that date can be sold through a transition period, but from 1 April 2027 it becomes an offence to sell vaping liquid without one. Our guide to the UK vape tax 2026 explains the duty and the key dates.
A high puff count on the box does not make a device illegal, and a low one does not make it legal. What matters is the liquid in each tank. Many big-puff devices stay within the rules by using a 2ml pod topped up from a separate refill container, or several 2ml tanks in one device. A single tank holding more than 2ml is not compliant, whatever the packaging says. Browse our TPD big puff vapes collection for high-puff devices designed around this limit.
Buying from a UK-based wholesaler removes most of these risks. Read why retailers choose a Manchester-based vape wholesaler.
Trading Standards can seize non-compliant products, issue fines and, for repeated or serious breaches, prosecute. HMRC can also seize unstamped vaping liquid once stamps become mandatory. On top of the legal risk, seized stock is money you will not get back. The rules on single-use disposable vapes since June 2025 add another layer to check, so it is worth reviewing your whole range against the rules once a quarter.
What does TPD compliant mean for vapes?
It means the product meets UK rules: no more than 2ml per tank, nicotine e-liquid in bottles of 10ml or less, a maximum strength of 20mg/ml, compliant packaging and warnings, and notification to the MHRA before sale.
How can I check whether a vape is MHRA notified?
Search for the product on the MHRA's published list of notified e-cigarette products. Your supplier should also be able to confirm notification for every product they sell. If neither can confirm it, do not stock it.
Are high-puff vapes legal in the UK?
Yes, provided each tank holds no more than 2ml and the product is MHRA notified. Many high-puff devices use a 2ml pod with a separate refill container. The puff count on the box does not decide legality; the liquid in each tank does.
Do vapes need a duty stamp in the UK?
Vaping liquid placed on the UK market from 1 October 2026 must carry a duty stamp. Older stock can be sold through a transition period, but selling vaping liquid without a stamp becomes an offence from 1 April 2027.
Who is responsible if a shop sells a non-compliant vape?
The retailer selling it can face Trading Standards action, including seizure and fines, even if they bought it in good faith. That is why buying from a UK wholesaler that checks compliance before listing products matters.
